Early Marriage in the Law

Practice, Comparative Law, Conflict of Law, Higher-ranking Laws

A comparative study authored by the Max Planck Institute for Comparative and International Private Law in 2020 at the behest of the German Federal Constitutional Court forms the basis of an edited volume that examines the legal, social and practical aspects of early marriage in a global context.

Edited by Nadjma Yassari, head of the Institute research group on the laws of Muslim jurisdictions, and Institute Director Ralf Michaels, the volume assembles practical and legal assessments from 21 primarily Institute-based researchers and thereby offers a detailed portrayal of early marriage as encountered across different legal systems and legal cultures. The collective work covers Islamically influenced countries in North Africa and the Middle East, various Latin American countries, European countries inside and outside the EU, the USA, and Japan. The country reports are preceded by a general comparative assessment as well as by entries analysing, respectively, international and European law in relation to early marriage, and individual issues arising under German constitutional law.
