Jürgen Basedow, our long-time director, passed away suddenly and unexpectedly on 6 April 2023. He was director at the Institute from 1997 to 2017 and remained present at the Institute after his retirement.

We are dismayed and speechless. Our thoughts are with his wife and family.

Erst spät habe ich erfahren, dass Prof. Basedow kurz vor Ostern verstorben ist. Das stimmt mich traurig. Mich hat Prof. Basedow neben vielen anderen Dingen darin beeindruckt, dass er alles, was man ihm schrieb, schnell aufgegriffen und brillant beantwortet hat. Gerne hätte ich ihm als ehemaliger Doktorand aus seiner Augsburger Zeit noch geschrieben, dass auch die Industrie von einem verlässlichen und einheitlichem Europäischen Privatrecht profitiert und z.B. Europäische Märkte in der Finanzindustrie seit vielen Jahren in Shared Service Centern von einem zentralen Standort mit weitgehend identischen Verfahren bearbeitet werden. Leider kann ich das nur noch in das Kondolenzbuch eintragen und nicht mehr persönlich schreiben. Der am 6. Apr. 2023 verstorbene Prof. Dr. Dr. multi. Jürgen Basedow ist mein guter Freund und mein respektierender Wohltäter. Mehr als 40 Jahre lang seit 1983 habe ich die gute Freundschaft mit ihm gehalten. Erstmal traf ich ihn am Max-Planck-institut für Ausländisches und Internationales Privatrecht (MPI) in Hamburg im Jahr 1983. Er war damals wissenschaftlicher Mitarbeiter des MPIs und ich war Gastforscher am MPI. Ich war an einem Gastzimmer geblieben und so oft hatte ich Mittag an der Kantine des MPIs gemeinsam mit ihm gegessen. An der Zeit des gemeinsamen Mittagessens hatten wir die damaligen politischen Situationen von Korea miteinander unterhalten. Ich versuchte, sie in die deutsche Sprache zu erzählen. Aber es war mir nicht leicht, sie ins Deutsch genau und ausführlich zu erzählen. Deshalb sagte ich ihm, dass ich Ihnen sie wegen meiner Armheit der Deuschsprache nicht genau und ausführlich sprechen konnte. Dagegen sagte er mir, “ich kann ganz kein Koreanisch sprechen”. Ich war von seiner solchen Aussage sehr schockiert. Danach war ich von seiner höheren Persönlichkeit sehr tief inspiriert. Bis jetzt kann ich seine tugendliche Aussage nicht vergessen haben und ich habe ihn unveränderlich respektiert. Er war sicherlich ein Kosmopolitanist und auch ein hoher persönlicher Rechtswissenschaftler. Im April dieses Jahres verlor ich meinen besten deutschen Freund. Aber er werde ewig im meinen Herzen bleiben.

Nach Rückkehr meiner Forschungen am MPI wurde er nach Augsburg Universität als Professor beruft und ich hatte als Professor mich in meines Fachgebiet in Korea vertieft. Mit Briefen und Weihnachtskarten hatten wir Nachrichten miteinander gesandt und genommen. Solche Kontakten mit ihm waren ungefähr mehr länger als 10 Jahre gedauert worden. Die Kontakten waren nicht untergebrochen worden. Bevor ich ihn am MPI zweitmal in 2000 wieder gesehen hatte, war er nach einer Universität in Berlin beruft worden. Durch einen deutschen Professor, der an der deutsch-koreanischen Tagung in Seoul teilgenommem hatte, hatte ich gehört, dass er nach der Humboldt Universität beruft worden war. Daher hatte ich einen Glückwünschesbrief nach der Humboldt Universität gesandt. Für so lange Zeit hatte ich keine Antwort von ihm erhalten. Nach einigen Monaten hatte ich den Antwortbrief von ihm erhalten. In seinem Brief hatte er gesagt, dass er nicht nach der Humboldt Universität sondern nach der Berliner Freien Universität beruft worden war. Glücklich war mein originaler Glückwunschesbrief durch deutsche Post unmittelbar von der Humboldt Universität zu der Berliner Freien Universität übergesandt worden. Ich kann solche schöne Erfahrung mit ihm nicht vergessen.

Prof. Dr. Dr. h.c. mult. Basedow war der Magister- und Doktorvater von meinem Sohn, Herrn Hwa Kim, der der Professor an der Ewha Frauenuniversität in Seoul ist. Er hatte meinem Sohn sehr freundlich und sehr ausführlich geleitet, so dass mein Sohn seine Dissertationsschrift sehr pünktlich fertig geschrieben konnte. Prof. Dr. Dr. h.c. mult. Basedow war sehr freundlich und hilfsbereit für meinen Sohn soeben nach der Erlangung des Doktorgrades gewesen.

Prof. Dr. Dr. h.c. mult. Basedow hatte sehr schöne Nominierungsschrift an der Humboldt-Stiftung für meinen Humboldt Forschungspreis. Die Nominierungsschrift war wunderschön und ausgezeichnet. Dank seiner schönen Nominierungsschrift hatte ich den Humboldt Forschungspreis in 2006. Mit grosser Hilfe auf meinen Empfang des Humboldt Forschungspreises wurde ich as Mitglied der Koreanischen Nationalen Akademie (The National Academy of Sciences, Republic of Korea (NAS)) ausgewählt in 2009. Prof. Dr. Dr. h.c. mult. Basedow war mir der gnädige Wohltäter. Ich habe ihn in der Vergangenzeit respektiert und respektiere ihn auch in dieser Zeit.

Prof. Dr. Dr. h.c. mult. Basedow hatte Korea viermal besucht, um Vorträge zu halten. Jedesmal hatte ich einige koreanische akademische Institute überredet, Prof. Dr. Dr. h.c. mult. Basedow einzuladen. Jedesmal hatte ich meinen Versuch für seine Einladung erfolgt. Erstmal hatte er den Korea Legislation Research Institute (KLRI) für seine Vortagshaltung der Globalisierung des Rechts besucht. Damals war er ziemlich lange Tage in Korea geblieben und eine Reise nach der schönen alten Hauptstadt der Shilla Dynastie, Kyeongju gemeinsam mit mir gemacht. Zweitmal hatte er Seoul nach seinem Teilnahme an der Tagung des International Academy of Comparative Law (IACL) in Fukuoka, Japan besucht. Er hatte also mehrere Vorträge an der einigen Universitäten in Seoul gehalten. Drittmal hatte er besonderen Vortrag über die quasi-internationalen Privatrecht zwischen Süd- und Nord-Korea am KLRI gehalten. Er war berühmter Rechtswissenschaftler des internationalen Privatrechts. Daher hatte ich ihn eingeladen, um seine Meinungen betreffend quasi-internationalen Privatrechts zwischen Süd- und Nord-Korea vor der Wiedervereinigung von Korea zu hören. Viertmal hatte er das NAS in 2021 besucht, um Vortrag über die neueste Entwicklung des EU Privatrechts zu halten. Obwohl COVID-19 damals weltweit erweitert und ausweitert war, hatte er persönlich an der Tagung des NAS in Seoul teilgenommen. Damals war ich von seiner tapferen Haltung beinflusst. Ich hatte als Geschäftsführender für die internationale Tagung des NAS gearbeitet. Unseres Treffen in Seoul 2021 war die letzmalige. Nach internatinaler Tagung des NAS hatte ich vorbeitet, ihn als Honorarmitglied des NAS zu empfehlen. Traurig hatte er mir keine Chance gebeben.

In Hamburg traf ich Frau von Prof. Dr. Dr. h.c. mult. Basedow und aß ich koreanische Küche an Norderstedt mit Ihr gemeinsam. Persönlich nahme ich an der Emeritierungstagung und –fest für Prof. Dr. Dr. multi. Basedow teil. Damals traf ich Frau und zwei Söhne von Prof. Dr. Dr. multi. Basedow. Während Teilnahme an der Tagung des NAS in Seoul habe ich die Nachricht über den ersten Sohn von Prof. Dr. Dr. multi. Basedow gehört.

Ich weiß, dass Prof. Dr. Dr. h.c. mult. Basedow der beste Schüler von Prof. Dr. Ulrich Drobnig war. Prof. Dr. Ulrich Drobnig hatte mich sehr geliebt. Er hatte mir grosse Unterstützungen für meinen Forschungsaufenthalt am MPI gegeben.

Prof. Dr. Dr. h.c. mult. Basedow war einer Vorbild des deutschen Wissenschaftlichers. Durch seiner Vorstellung konnte ich einen wissenschaftlichen Kontakt mit dem ehemaligen Professor an der Trier Universität Prof. Dr. Bernd von Hoffmann machen und internationalen Tagungen des Bodenrechts mit ihm sowohl in Deutschland als auch in Korea gehalten.

Von dem Beginn des Treffens mit Prof. Dr. Dr. h.c. mult. Basedow bis jetzt war ich von die höchste Persönlichkeit von ihm beinflusst und ich hatte ihn beständlich respektiert. Ich habe einen grossen deutschen Freund verloren. Aber er lebt in meinem Herzen und in meiner Erinnerung. Mein Sohn werde auch ihn respektieren und seine Rechtswissenschaft kontinuerlich weiter ver- und nachfolgen.

Mit meinem Herzem wünsche und bete ich Prof. Dr. Dr. h.c. mult. Basedow schönes sowie ruhiges Leben im Himmel des Gottes. Auch hoffe ich, ihn im Himmel in Zukunft wiederzusehen. Weiter wünsche ich Friede und Gnade des Gottes an den allen hintergelassenen Familien! Prof. Dr. Jürgen Basedow hat mir ein Einladungsschreiben geschickt. Ich lernte lieben Herrn Kollegen Jürgen Basedow im Jahr 1988 persönlich kennen. Damals war er an der Universität Augsburg. Er bot mir an, einen Gast-Vortrag an seiner damaligen Universität zu halten. Ich hatte seinen Vortrag (Rechtwahl und Gerichtsstandsvereinbarungen im neuen Recht, Schriften des Deutschen Vereins für Internationales Seerecht, A/Heft 64, 1987) ins Japanische übersetzt, und dadurch seine ausgezeichneten Ideen den japanischen Kollegen vorgestellt. Jürgen Basedow était un grand juriste. En partie formé, dans sa jeunesse, à l'Institut de droit comparé, il a gardé un attachement profond à au 28 rue St Guillaume, où nous nous retrouvions régulièrement, lors des réunions de l'Académie internationale de droit comparé. Il était membre  de la société de législation comparée et de la revue internationale de droit comparé, docteur honoris causa de l'Université Panthéon-Assas où il est plusieurs fois venu enseigner;  en français. Il avait un enthousiasme communicatif pour le droit international privé et le droit comparé. Si sa pensée juridique a marqué et marquera des générations de juristes, c'était aussi un homme d'action, qui savait mener à bien les projets les plus ambitieux, toujours avec gentillesse et implication inouïe. Professor Basedow taught me many important things relevant both for my professional academic endeavors as well as my personal affairs. Mit dem Tod von Jürgen Basedow hat die Rechtswissenschaft eine herausragende Persönlichkeit verloren. Er hat in vielen Bereichen der Jurisprudenz großartige Leistungen erbracht. Neben dem internationalem Privatrecht und der Rechtsvergleichung hat er bahnbrechende Werke im Kartellrecht, Versicherungsrecht und mehreren anderen Rechtsgebieten verfasst. Ich bin ihm und seinem Andenken zu besonderem Dank verpflichtet für die jahrzehntelangen akademischen Verbindungen, die er mit meinem Institut unterhielt. Das letzte Ereignis dieser fruchtbaren Zusammenarbeit wäre der Vortrag gewesen, den er Mitte Mai auf der internationalen Konferenz in Budapest über die Kodifizierung des Privatrechts gehalten hätte. Mit Jürgen Basedow haben wir ein Ehrenmitglied der Ungarischen Akademie der Wissenschaften und einen der aktivsten Partner des Insitus für Privatrecht und Internationales Privatrecht der Eötvös-Lorand-Universität verloren. Es war für mich eine sehr traurige und vollkommen unerwartete Nachricht. Ich habe ihn im Jahr 1986 kennengelernt als ich selber im MPI recherchierte. Kurz danach war er dabei als wir die Argentinisch-Deutsche-Juristenvereinigung gegründet haben. Oft hat er an unseren Kongressen teilgenommen, immer mit seiner Weissheit allen die Augen geöfnet. Professor Basedow always inspired me with his remarkable personality, open mind, kindness and thoughtfulness. I have first met Professor in person at Max Planck Institute in Hamburg in 2009 during my scholarship period and thus I had a privilege to talk to him exchanging thoughts on development of private international law in Eastern and Western Europe. Subsequently we kept correspondence from time to time and I was impressed with his readiness to share his views and provide support despite Professor's obviously busy schedule. The last time I met Prof. Basedow is in June 2022. I was only in MPI for one week. With short notice, Prof. Basedow still kindly organized an appointment within his busy schedule to meet me in his office. This was a pleasant surprise because before that I only met him once more than ten years ago. He prepared good coffee and cookie for me. He was so kind and knowledgeable. We discussed the service of process under the Hague Convention because I was writing papers on that subject. He gave me a lot of good advice. I was very shocked that he passed away. I have known Prof. Jürgen Basedow since 2007, and I was impressed by his depth of knowledge combined though with his practical approach to things. In my regular visits every summer at the MPI since 2011, he was always available and keen to discuss even the most unanticipated academic topics, ready to share his intriguing views. Professor Dr. Dr. h. c. mult. Jürgen Basedow verstarb am 6. April 2023 im Alter von 73 Jahren. Er war seit der Gründung des Wissenschaftlichen Beirats des BdV im Jahre 1992 bis 2007 einer seiner führenden Köpfe. Zuerst von der Universität Augsburg aus, dann als Direktor am Max-Planck-Institut für ausländisches und internationales Privatrecht in Hamburg unterstützte er den BdV umfassend bei seinen Initiativen zur Verbesserung der Transparenz der Lebensversicherung. Mit einem Rechtsgutachten bereits 1992 kritisierte er die damaligen gesetzlichen Regelungen zum Rückkaufswert und zur Überschussbeteiligung, die seiner Ansicht nach gegen das AGB-Recht verstießen. Dadurch leistete er einen wesentlichen Beitrag für die späteren Erfolge des BdV vor dem Bundesgerichtshof und dem Bundesverfassungsgericht, die zur Einführung von Mindestrückkaufswerten und der Beteiligung an Stillen Reserven für die Lebensversicherten führten. Auch die Möglichkeit der vorzeitigen Kündigung von damals üblichen 10-Jahresverträgen, die Begrenzung der Provisionszahlungen auf fünf Jahre nach Vertragsabschluss sowie die Einrichtung des Versicherungsombudsmannes gehören mit zu seinen großen Verdiensten.

Durch seine Tätigkeit im Wissenschaftlichen Beirat und die Organisation der jährlichen Wissenschaftstagungen hat Professor Basedow einen immensen Anteil an der öffentlichen Anerkennung der Arbeit des BdV. Vorstand und Mitarbeiter des BdV haben Professor Basedow viel zu verdanken und werden ihm gegenüber stets die beste Erinnerung bewahren. I was very saddened when I heard of Jurgen’s untimely death. We worked closely on the project for the restatement of European Insurance contract law, especially on the drafting committee that produced the Principles of European Insurance Contract Law. Professor Jürgen Basedow führte über 20 Jahre den Vorsitz im Beirat des Versicherungsombudsmann e. V. In den ersten Jahren des Gremiums prallten die Interessen der Verbraucher und Versicherer oftmals heftig aufeinander, nicht selten getrieben von lebhaften Emotionen. Dank des Geschicks, der Erfahrungen, der natürlichen Autorität von Prof. Basedow und nicht zuletzt seines Humors wurde die Energie letztlich immer in konstruktive Bahnen gelenkt. In diesen zwei Jahrzehnten gab er zudem wertvolle Impulse und Ratschläge, die zur Entwicklung der als vorbildlich angesehenen Schlichtungsstelle maßgeblich beitrugen. Als Geschäftsführer des Vereins arbeitete ich mit Prof. Basedow fast seine gesamte Amtszeit zusammen. Von Beginn an schenkte er mir sein Vertrauen, bald durfte ich auch seine Wertschätzung genießen. Seine überragende Fachkompetenz trug er nie vor sich her. Prof. Basedow verwendete seine exzellenten Rechtskenntnisse stets sachbezogen, Menschen war er immer sehr zugewandt. I am so sad to hear that Prof. Basedow passed away in Hamburg. I was his doctoral student from 2011 to 2015. I came from Vietnam to Hamburg and received his tremendous mentor. I met Prof. Basedow in 2000 at the Max Planck Institute for Comparative and International Private Law, when I was there for a scholarship. I asked him for an appointment to present a souvenir from Iran, which he accepted with open arms. Contrary to expectations, our meeting lasted about 2 hours. I had the opportunity to a visiting scholar at the Max Planck Institute for Comparative and International Private Law several times and to know him personally. My last meeting with Prof. Basedow was in the summer 2022, while I was visiting Max Planck Institute in the scope of my research scholarship. I cannot believe that it was my last communication with the honorable professor and my dear friend. He was so enthusiastic and motivated to continue his work and proceed his academic activities, he was involved in many projects and activities, all his efforts were invaluable for the advancement of comparative and international private law and he supported greatly many universities and scholars, including Tbilisi State University. Our cooperation lasted for years. In 2012 Prof. Basedow was acknowledged as the honorary doctorate (Doctor Honoris Causa) of Tbilisi State University by the Rector’s decree. He facilitated cooperation between the Max Planck Institute and TSU, organized and participated in many conferences at TSU. He was a great friend of Georgia. 

In May 2023 we had planned a joint conference and we changed the date to November in agreement with him. He had so many plans for the future.

I would like to reiterate my deepest condolences to the Max Planck Institute for Comparative and International Private Law caused by the death of Prof. Basedow.
