Prof. Dr. Daniel Rojas-Tamayo (Universidad Externado de Colombia): Recent Developments in Latin America’s Private International Laws

Latin America Roundtable

  • Date: Mar 14, 2024
  • Time: 04:00 PM (Local Time Germany)
  • Location: hybrid event

About the Speaker:
Daniel Rojas-Tamayo is an Associate Professor of the Department of Civil Law at the Externado University of Colombia. Daniel’s research focuses on the development of private international law in Colombia. He has published a book titled “The Law Applicable to the Contract in Colombian Private International Law. Comparative, Critical and Prospective Study” and several articles on choice of law in contracts and torts.

About the Topic:
In recent years, several Latin American countries have adopted rules, or modified existing ones, in the field of private international law. Even in countries that used to be reluctant, draft legislation on the subject is under discussion. Nevertheless, the scope of recent laws and drafts remains uneven. Furthermore, most Latin American countries are contracting parties to various treaties on private international law drafted by the Organization of American States. Hence, the adoption of choice of law rules at the national level may interfere with both regional and global unification initiatives and complicate their application. The lecture aims to compare the recent laws and drafts as well as to examine their relationship with regional and global treaties.

About the Seminar Series:
In the Latin America Roundtable, academics researching the law of Latin American countries or regional uniform law present their work at the Institute. Employees of the Institute, visiting scholars and all interested parties have the opportunity to obtain first-hand information on the latest developments in the various areas of civil law in Latin American countries.

The lecture will be held as a hybrid event, both on site at the Max Planck Institute for Comparative and International Private Law, Mittelweg 187, 20148 Hamburg, and as a video conference via Zoom.
