About the Topic
In the fourth session of the Trialogues,
Hannah L. Buxbaum will examine recent developments in the use of
anti-suit and anti-enforcement injunctions in the United States and in
comparative perspective, analysing their role in managing conflicts
arising in transnational litigation and arbitration. Special emphasis
will be given to the exceptional nature of anti-enforcement injunctions,
the challenges they pose to the strong and essentially universal policy
in favour of res judicata, and the tensions they create with foreign
legal systems.
The session will take place in a trilingual format,
giving participants the chance to engage in English, Spanish, and
Portuguese.
The MPI-ASADIP Trialogues in Private International Law is a multilingual academic event series exploring current developments in Private International Law across the Americas. Organized by the Max Planck Institute (Hamburg) in cooperation with the Asociación Americana de Derecho Internacional Privado (ASADIP), the series fosters intercultural dialogues in Private International Law in English, Spanish, and Portuguese.
