The Private International Law Dimensions of War and Migration
Research project
War complicates or even completely obstructs the normal course of private relations with foreign elements, both physically and legally. Performing under contracts becomes significantly more complicated if not impossible. Spontaneous migration ensues, including by large numbers of unaccompanied children or of children accompanied by adults whose custody rights are questionable under the law of the states they migrate to. This project examines the suitability of the private international law rules of international jurisdiction, the applicable law, and the recognition and enforcement of foreign judgments for the challenges of war and war-driven migration.
