PRINCIPLES OF EUROPEAN INSURANCE CONTRACT LAW

In January 2013 the European Commission established an Expert Group on Insurance Contract Law. The group shall explore whether differences in the insurance contract laws of the Member States create barriers to cross-border insurance coverage and, if so, in which specific insurance areas this is the case. The step signifies that the contemplated harmonisation of this legal field has entered a new – and now politically based – phase. The effort builds upon many years of research which was initiated at the Max Planck Institute as early as the end of the 1990s under the guidance of Director Jürgen Basedow. This work began with a three-volume comparative survey of insurance contract law in the nations of Europe (2002/2003) and continued with the recommendations of the Project Group: Restatement of European Insurance Contract Law, which in 2009 published the Principles of European Insurance Contract Law (PEICL). Professor Basedow is also a member of the Expert Group appointed by the European Commission.
