Globalization of Competition Law

The manuscript is entitled „Globalization of Competition Law – An International Competition Order between Antitrust Law and World Trade Law“. In Spring of 2007, it was accepted as a „Habilitationsschrift“ by the Law Faculty of the University of Hamburg. It will be published in the book series „Beiträge zum ausländischen und internationalen Privatrecht“. The text is organized in four chapters. In the first chapter it deals with the internationalization of competition policy in general, including its causes and consequences as well as its theoretical background. The second part describes the various attempts for a global regulation of competition law that have, so far, been made. The third chapter looks for other solutions that might serve as alternatives to the globalization of competition law, as, for example, unilateral measures by national governments, crossborder cooperation of competition authorities, or regional competition regimes. The final chapter is dedicated to reform projects that seek to improve the status quo in international competition law. In its own proposal, the author favors a global competition regime within the regulatory framework of the World Trade Organization (WTO) based on a „constitutional“ model.
