As part of the "Hamburg Lecture Series on Chinese Law", economic law expert Prof. Dr. XU Guojian (Shanghai) will hold a lecture at the Max Planck Institute for Comparative and International Private Law. On Wednesday, 9 December 2009 at 5:00 P.M. he will speak on the topic "Settlement of Commercial Disputes in China: Arbitration v. Litigation". The talk will be presented in English (both English and German are avaiable for ensuing discussion). Participation is free and advance registration is not required. In his talk, Prof. XU will address dispute resolution mechanisms currently available in China. In particular, he will consider the advantages and disadvantages of judicial and extra-judicial procedures as well as the question of recognition and enforcement of arbitral awards in China. His comments will draw from the practical insight and experience he acquired while partner in the renowned Shanghai law firm of Boss & Young. Information on the Speaker: Prof. Dr. XU Guojian studied law at the Southwest University of Political Science and Law in Chongqing and the Wuhan University in Wuhan. In 1988 he came to Europe to continue his legal studies. Lengthy research stays at the Swiss Institute for Comparative Law in Lausanne, the Hamburg Max Planck Institut for Private Law and the University of Freiburg ultimately led to the conferral of his doctorate in 1994. Simultaneous to his studies, XU Guojian was also engaged in the practice of law. In 1995 he helped to established the first branch of a foreign law firm in Shanghai. Later, in 1998, he was a founding partner of the law firm of Boss & Young in Shanghai. XU Guojian is recognised as an expert in Chinese economic law by more than 40 Chinese and international publications. |
