In cooperation with the German-Greek Jurists' Association, the Max Planck Institute for Comparative and International Private Law invites you to attend an evening program of lecture and discussion on 11 November 2011.Prof. Dr. Peter Mankowski (University of Hamburg) will speak on the topic of the harmonisation of European international private law and procedural law.
It is the aim of the EU to facilitate the assertion of rights by private parties in cross-border matters. Individuals should - namely - be in a position to benefit from the area of freedom, security and justice which the EU represents. Toward this goal, an array of procedural instruments have been enacted since 2004 which have created new uniform European regimes and done away with older institutions such as the proceedings necessary to secure an order of enforcement (Vollstreckbarerklärungsverfahren). Uncontested demands and minor claims stand equally affected. As a practical matter, the new expansion in the field of maintenance claims is likely of the greatest significance. Europe has even compelled its Member States to introduce collection enforcement proceedings for cross-border contexts. At the same time, the EU is intervening with increasing regularity in respect of conflicts of laws. The Rome Regulations are multiplying. The PIL of contracts (Rome I) has already found its equal in the PIL of non-contractual obligations (Rome II) and international divorce law (Rome III). We stand on verge of a European regime on international succession (Rome IV), and proposals for a marital property regime for "conventional" marriages as well as for registered partnerships have been introduced this year.
The lecture by Professor Mankowski will offer an overview of these developments. Of particular focus will be the consequences for legal practice.
