30 Years of Opening and Reform: Whereto next in Chinese Law?

Since the end of the Cultural Revolution and with its policy of "Opening and Reform", announced in 1978, the People's Republic of China has undertaken the transformation of its legal character. Steadfastly, China has attempted to create for itself a new legal regime meeting the demands of a modern economy. Included in the effort has been an unhesitant willingness to look to the experiences of foreign legal systems. The frequent reference to German law as a model for the creation of Chinese laws can be explained in part historically and in part due to the high degree of systematisation in German law which facilitates its reception. This opening of the People's Republic of China has been met by a growing interest among German jurists regarding the transforming Chinese legal system.

In the course of these developments the German-Chinese Jurists' Association (Deutsch–Chinesische Juristenvereinigung [DCJV]) was, in the summer of 1986, founded. Presently, Prof. Dr. Uwe Blaurock from the University of Freiburg is its president. The DCVJ has the mission of promoting a familiarity and understanding of Chinese law in Germany as well as a reciprocal knowledge of German law in the People's Republic of China. It aims to foster academic and professional exchange between interested jurists from each country. Additionally, the association is striving to expand and intensify connections with legal organisations in the People's Republic of China.

This year, the DCJV is holding its annual conference in cooperation with the Hamburg Max Planck Institute for Comparative and International Private Law as part of the China-Time 2008 program. The conference will offer a forum for practitioners and scholars who are engaged with Chinese legal issues, but it is also open to businesses and other individuals with an interest in China. Lectures and discussions tackling current themes will consider in what direction Chinese law is developing 30 years after its having adopted a policy of "Opening and Reform".
